Terms of Service
These Terms govern your use of Nukxon. By creating an account or using the service, you agree to them. We've kept the language plain. If anything is unclear, email contact@nukxon.com.
1 · The service
Nukxon, LLC ("Nukxon") provides a software platform that converts architectural 3D models into browser-based virtual tours and offers collaboration features (annotations, measurements, voice review, sharing, embedding). The service runs in the browser and through plugins that integrate with third-party design tools.
2 · Your account
- You must be 16 or older and have authority to enter contracts to create an account.
- You're responsible for keeping your credentials secure and for all activity on your account.
- One person or business per account. You may invite collaborators per the seat limits of your plan.
- Notify us immediately at contact@nukxon.com if you suspect unauthorized access.
3 · Acceptable use
You agree not to:
- Upload content you don't have rights to use, or that infringes third-party intellectual property
- Use the service to host illegal, harassing, or harmful content
- Reverse-engineer, scrape, or attempt to extract source code or model weights from the platform
- Resell or sublicense the service without our written permission
- Circumvent rate limits, storage caps, or seat counts on your plan
- Use the service to compete with us by building a substantially similar product
4 · Your content
You keep ownership of everything you upload — your 3D models, scenes, annotations, and supporting assets. You grant Nukxon a worldwide, non-exclusive license to host, process, transmit, and display your content as needed to operate the service for you and the people you share it with. This license ends when you delete the content or your account.
You're responsible for the content you upload. You represent that you have the rights to all material you publish and that publishing it does not violate the law or anyone's rights.
5 · Plans, billing, and refunds
- Paid plans are billed in advance on a monthly or annual cycle as you select.
- You can cancel anytime; cancellation takes effect at the end of your current billing period.
- We do not provide refunds for partial periods, but we will work with you in good faith on billing disputes.
- We may change pricing for new sign-ups at any time. Existing subscribers receive at least 30 days' notice before any price increase affecting their plan.
- Founding members who subscribed during early access lock in their plan price for as long as their subscription remains active and uninterrupted.
6 · Free trials and beta features
We may offer free trials, free tiers, or beta features. These may be limited, modified, or discontinued at any time without notice. Beta features are provided "as is" and may behave unpredictably; do not rely on them for production-critical work.
7 · Our intellectual property
The Nukxon software, plugins, design, brand, and documentation are owned by Nukxon, LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use them as part of the service. We retain all rights not expressly granted.
8 · Third-party services
Nukxon integrates with third-party tools (e.g., Blender, Unreal Engine, SketchUp, 3ds Max) and uses third-party providers (listed in our Privacy Policy). We are not responsible for the availability, accuracy, or terms of those third parties.
9 · Suspension and termination
We may suspend or terminate your access if you violate these Terms, fail to pay fees when due, or use the service in a way that risks harm to us or other users. We will give you reasonable notice when feasible. Upon termination, your project content is retained for 30 days for export, then permanently deleted. You may close your account at any time by emailing us.
10 · Disclaimers
The service is provided "as is" and "as available." While we work hard to keep it reliable, we don't guarantee uninterrupted operation, error-free results, or that the service will meet every specific requirement of your business. To the fullest extent permitted by law, Nukxon disclaims all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11 · Limitation of liability
To the fullest extent permitted by law, Nukxon's total liability for any claim arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $100. Nukxon is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption. Some jurisdictions don't allow these limitations; in those, this section applies to the maximum extent permitted.
12 · Indemnification
You agree to indemnify and hold Nukxon harmless from any third-party claim arising out of (a) content you upload, (b) your violation of these Terms, or (c) your violation of someone else's rights.
13 · Changes to these Terms
We may update these Terms as the service evolves. Material changes will be announced via email and shown on this page with a new "Last updated" date. Continued use after the effective date constitutes acceptance.
14 · Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction.
